PROBLEMS OF CLASSIFYING LEGAL ENTITIES AS CORPORATE AND UNITARY ONES IN THE EXISTING CIVIL LEGISLATION

Background. The existing system of legal entities has been introduced an amendment in part one of the Civil Code of the Russian Federation that for the first time designated organizational and legal forms, within which collective subjects can be created, as well as divided them by types. Today standards of chapter 4 of the Civil Code of the Russian Federation has undergone essential changes that affect the bases of creation of the system of legal entities. To explain the point and purposes of such changes it is necessary to address to the existing scientific approaches to this problem, and also to the analysis of the existing civil legislation that fixed new classification of legal entities. The research objective is to investigate the existing civil legislation of the Russian Federation fixing division of legal entities on corporate and unitary, to carry out the analysis of its contents.
